Sando Cashback Program Terms and Conditions
1. Introduction
Welcome to the Sando Cashback Program ("Program"). These Terms and Conditions ("Terms") govern your participation in the Program. By participating in the Program, you agree to these Terms, our Privacy Policy, and any other terms and conditions referenced herein.
2. Eligibility
2.1 The Program is open to individuals who are at least 18 years old and are legal residents of the United States.
2.2 Participation in the Program is limited to individuals with an active Sando account.
3. Enrollment
3.1 To participate in the Program, you must enroll through our website or mobile application.
3.2 By enrolling, you agree to provide accurate and complete information.
4. Earning Cashback
4.1 Cashback can be earned on eligible purchases made through Sando or affiliated partners.
4.2 The percentage of cashback and the specific terms for earning cashback may vary depending on the product, service, or partner.
4.3 Cashback will be credited to your account within a specified period after the purchase is confirmed by the merchant.
5. Redeeming Cashback
5.1 Accumulated cashback can be redeemed through methods specified on our platform, such as bank transfers, PayPal, gift cards, or other payment options.
5.2 Minimum redemption threshold of $5.01 applies to all withdrawals.
5.3 Cashback cannot be transferred, exchanged for cash, or used as payment for any other services outside those specified by the Program.
6. Account Maintenance
6.1 You are responsible for maintaining the confidentiality of your account information.
6.2 Notify us immediately of any unauthorized use of your account.
7. Termination and Suspension
7.1 Sando reserves the right to terminate or suspend your participation in the Program at any time if you violate these Terms or engage in fraudulent activity.
7.2 You may terminate your participation in the Program at any time by closing your account.
8. Changes to the Program
8.1 Sando reserves the right to modify or terminate the Program at any time. We will provide notice of significant changes by posting them on our website or notifying you directly.
8.2 Continued participation in the Program after any changes constitutes acceptance of the revised Terms.
9. Limitation of Liability
9.1 To the maximum extent permitted by law, Sando is not liable for any indirect, incidental, or consequential damages arising out of or related to the Program.
9.2 Sando's total liability to you for any claims arising out of or related to the Program is limited to the amount of cashback you have earned in the past 12 months.
10. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflict of law principles.
11. Arbitration Clause
11.1 Agreement to Arbitrate
By participating in the Program, you and Sando agree that any dispute, claim, or controversy arising out of or relating to the Program, these Terms, or the breach, termination, enforcement, interpretation, or validity thereof, including the determination of the scope or applicability of this agreement to arbitrate, shall be resolved through binding arbitration.
11.2 Arbitration Procedure
The arbitration shall be administered by the American Arbitration Association ("AAA") under its Commercial Arbitration Rules and, if applicable, the Supplementary Procedures for Consumer-Related Disputes. The arbitration shall be conducted by a single arbitrator chosen in accordance with the AAA rules. The arbitration shall take place in Chicago, Illinois.
11.3 Arbitration Costs
Each party shall bear its own costs and expenses related to the arbitration, including attorneys' fees. The arbitrator's fees and any administrative costs of the arbitration shall be shared equally by the parties, unless otherwise provided by the AAA rules or ordered by the arbitrator.
11.4 Final and Binding Award
The arbitrator's award shall be final and binding on the parties and may be entered as a judgment in any court of competent jurisdiction. The arbitrator shall have the authority to award any relief that would otherwise be available in court, including injunctive and declaratory relief and compensatory damages.
11.5 Exceptions to Arbitration
Notwithstanding the foregoing, either party may seek temporary or preliminary injunctive relief from a court of competent jurisdiction to protect its rights pending arbitration. Claims related to intellectual property rights, including but not limited to trademarks, trade dress, domain names, trade secrets, or copyrights, are not subject to this arbitration agreement.
11.6 Waiver of Class Actions
You and Sando agree that any arbitration shall be conducted only in an individual capacity and not as a class action or other representative action. The arbitrator shall have no authority to consider or resolve any claims or issues subject to arbitration on a class-wide or representative basis.
11.7 Governing Law
This Arbitration Clause shall be governed by and construed in accordance with the Federal Arbitration Act and, to the extent not preempted by federal law, the laws of the State of Illinois, without regard to its conflict of law principles.
